Terms and Conditions
This agreement outlines the legal Terms and Conditions for
using iSplash Sandbox (“the service”), provided by idash Software (“we”, “us”,
or “our”). By registering for an iSplash Sandbox account, you acknowledge and
agree to these Terms and Conditions and any associated policies. Please read
them carefully before signing up to ensure you fully understand the terms of
use for our services.
1 Entering into an agreement with iSplash Sandbox
1.1 iSplash Sandbox
iSplash Sandbox is an online sandbox version of the iSplash product, designed
for demonstration and testing purposes. iSplash is a sports management platform
that enables staff members of sports organizations to manage their classes,
users (referred to as "members" or "students"), and
students (referred to as "users" or "children"). Members
can use the system to view their upcoming classes and track student progress.

1.3 About us
IMPORTANT: iSplash Sandbox is a shared testing environment. This means other users will be able to see and interact with test data you create, and you will see their test data too.
By registering for iSplash Sandbox, you represent and warrant that:

By registering for and accessing iSplash Sandbox, you enter into an
agreement with idash Software under the following terms:

If you violate any of these Terms and Conditions, or engage in any activity
that is unlawful or harms iSplash Sandbox, we reserve the right to take the
following actions:
We reserve the right to investigate any breach of these
Terms, and in doing so, we may cooperate with legal authorities as required by
law.
2 Unacceptable Use of iSplash Sandbox
2.1 Prohibited Content
Users of iSplash Sandbox are prohibited from posting, transmitting, or storing
any content that:

may face account suspension, termination, or other actions as outlined in the
"Violation of Terms" section.
2.2 Prohibited Behaviour
Users of iSplash Sandbox are prohibited from engaging in any of the following
behaviors:
Users found to be engaging in prohibited behavior may face
immediate suspension or termination of their account, as well as any other
actions deemed necessary by idash Software.
2.3 Reporting Violations
Users are encouraged to report any suspected violations of
these Terms and Conditions, including prohibited content or behavior. Reports
can be submitted to softwaresupport@idash.co.uk. All reports will be taken
seriously and investigated accordingly.
2.4 Consequences of Violations
Users who engage in repeated or severe violations of these
Terms and Conditions may face permanent suspension from iSplash Sandbox, in
addition to any other penalties outlined herein.
2.5 User Accountability
You are solely responsible for any content you create, post,
or share within iSplash Sandbox, as well as for any actions taken under your
account. While you retain ownership of your content, idash Software reserves
the right to monitor, review, and remove any content that violates these Terms
and Conditions or is deemed inappropriate. We are not liable for any content
generated by users, but we may take action to ensure compliance with our
guidelines and maintain a safe and respectful environment within the sandbox.
2.6 Disclaimer of Liability
idash Software is not responsible for the content posted by
users or for any violations of these Terms and Conditions. Users assume all
risks associated with their interactions with other users and any content they
create.
3. Your Account
3.1 Account Registration
To access iSplash Sandbox, you must create an account. During the registration
process, you agree to provide accurate and complete information, including your
first name, last name, email address, telephone number, and company name.
Please note that your company name will not be stored in the sandbox database,
but all registration data will be sent to softwaresupport@idash.co.uk. This
information allows us to know who is registering and enables us to contact you
if necessary.
If you provide inaccurate or misleading information, such as
an incorrect email address, you may not be able to complete the registration
process, as you will need to verify your account by setting a password through
an email link. While we cannot verify the accuracy of your name, telephone
number, or company name, providing false information may hinder your access to
the iSplash Sandbox and violate our Terms and Conditions. You are responsible
for maintaining the accuracy of your account information and must update it as
necessary.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account
credentials, including your username and password. If you suspect any
unauthorized access or security breaches, you must notify us immediately. We
cannot be held liable for any loss or damage arising from your failure to
protect your account information.
3.3 Account Activity
You are solely responsible for all activity that occurs under your account.
This includes any content you create, actions taken, or communications made
within iSplash Sandbox. idash Software is not liable for any unauthorized
access or use of your account.
3.4 Account Suspension or Termination
We reserve the right to suspend or terminate your account at our discretion if
you violate these Terms and Conditions or engage in any prohibited behaviour as
outlined in Section 2. In the event of termination, any data or progress
associated with your account will be permanently deleted.
3.5 Changes to Account Information
You may update your account information at any time through your account
settings. It is your responsibility to keep your information current and
accurate. Failure to do so may affect your ability to use iSplash Sandbox.
3.6 Deactivation of Account
Users may deactivate their account at any time by following the instructions in
their account settings. Please note that deactivating your account will result
in the loss of all data associated with it, which cannot be recovered. If you
wish to reactivate your account, you may need to go through the registration
process again.
4 Data Protection and Privacy
idash Software acts as the Data Controller for all personal data processed within iSplash Sandbox, as defined in the Data Protection Act 2018 and UK GDPR. This is because iSplash Sandbox is a demonstration environment where:

5 The Legal Bit
5.1 Disclaimer
ISplash Sandbox is provided on an "as is" and "as
available" basis. idash Software makes no representations or warranties of
any kind, express or implied, regarding the operation of the service or the
information, content, materials, or products included in the service. To the
fullest extent permissible by applicable law, we disclaim all warranties,
express or implied, including, but not limited to, implied warranties of
merchantability and fitness for a particular purpose.
Furthermore, idash Software shall not be liable for any
interruptions or disruptions to the service, whether due to scheduled
maintenance, unforeseen technical issues, or any other reason. We strive to
minimize downtime but do not always guarantee uninterrupted access to iSplash
Sandbox.
5.2 Intellectual Property Rights
All intellectual property rights in iSplash Sandbox and its content, including
but not limited to software, design, graphics, and text, are owned by or
licensed to idash Software. You may not use, reproduce, or distribute any
content from iSplash Sandbox without our prior written consent.
5.3 Limitation of Liability
To the maximum extent permitted by law, idash Software shall not be liable for
any direct, indirect, incidental, special, consequential, or punitive damages
arising from or related to your use of iSplash Sandbox, including but not
limited to loss of data, profits, or goodwill.
5.4 Indemnity
You agree to indemnify, defend, and hold harmless idash Software, its
affiliates, and their respective officers, directors, employees, and agents
from any claims, losses, liabilities, damages, costs, or expenses (including
reasonable attorney fees) arising out of or related to your use of iSplash
Sandbox, your violation of these Terms and Conditions, or your infringement of
any intellectual property or other rights of any person or entity.
5.5 Breaches of these Terms and Conditions
If you breach any of these Terms and Conditions, we reserve the right to take
appropriate actions, including but not limited to suspending or terminating
your access to iSplash Sandbox, as outlined in Section 3.4.
5.6 Variation
We reserve the right to modify these Terms and Conditions at any time. Any
changes will be effective immediately upon posting on our website. Your
continued use of iSplash Sandbox following any changes constitutes your
acceptance of the new Terms and Conditions.
5.7 Governing Law
These Terms shall be governed by and construed in accordance with the laws of
England and Wales. Disputes arising with these Terms shall be subject to the
non-exclusive jurisdiction of the English or Welsh courts.
Nothing in these Terms seeks to limit or exclude consumers’
legal rights.
